This Service Agreement (“Agreement”) is entered into between DS Consulting Club / The GrowPro Shop (“we”, “our”, or “us”) and the client (“you”, “your”) upon purchase of any Digital Graphics Design Service. By confirming your order, you agree to the following terms and conditions.
1. Scope of Services
We will provide digital design services based on the product(s) selected at checkout.
Available Services:
A. Website Graphics Design
Includes the design of up to 10 digital graphic elements, which may consist of:
- Website banners
- Call-to-action buttons
- Icons
- Section headers or visual dividers
- Product or feature highlights
B. Email Newsletter Design
Includes a custom-designed email layout for marketing, updates, or announcements.
- Designed in line with your branding
- Optimized for general email platforms
- Delivered as an image-based layout (not HTML-coded)
2. Deliverables
- High-resolution digital files (JPG, PNG, or PDF format, as appropriate)
- One (1) round of revision per item
- Final delivery within 5–7 business days from receiving a complete brief and all required materials
3. Client Responsibilities
You agree to:
- Submit a complete brief including brand assets (logo, color palette, fonts), messaging, and any content to be featured
- Respond promptly to clarification requests and revision approvals
- Approve final designs within five (5) business days of delivery
Incomplete or delayed input may result in extended timelines.
4. Revisions & Additional Work
- One (1) round of revision per design is included
- Additional revisions or scope changes will be billed separately upon agreement
- If design elements exceed the package (e.g., more than 10 graphics for website), a custom quote will be provided
5. Exclusions
This service does not include:
- Website development or coding (HTML, CSS, JavaScript)
- Newsletter integration with platforms (e.g., Mailchimp, Klaviyo)
- Editable source files (e.g., AI, PSD) unless agreed separately
- Copywriting or stock photography sourcing
6. Ownership & Usage Rights
- Upon full payment and final delivery, you are granted full usage rights for the digital graphics created
- We retain the right to include anonymized versions in our design portfolio unless you request otherwise in writing
7. Confidentiality
All business, brand, and marketing information shared with us will be treated as confidential and will not be disclosed to third parties without your consent, unless required by law.
8. Limitation of Liability
We are not responsible for:
- Technical performance of third-party platforms (e.g., email software, website CMS)
- Errors in content provided by the client
- Any issues arising from improper use of the graphics or failure to apply them as intended
9. Acceptance of Terms
By purchasing this service, you confirm that you have read, understood, and agreed to the terms of this Agreement. This Agreement becomes effective upon payment and remains valid until delivery of all agreed design materials.
